Can I get a POA over my mother's medical situation at the age of 18?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
I commend you on your initiative in learning about your mother's conditions and identifying possible treatment options. Unfortunately, your age makes it unlikely that you would be granted power of attorney for her health care decisions. There are several non-medical ways you can aid your mother during her illness, such as helping to establish a supportive home environment, reminding her to stay on her medications, and encouraging her to eat properly. If you can go with your mother to her next medical appointment, you can share your concerns with her doctor and ask for assistance in getting her the help she needs.

How do I get my name on my parents' house deed?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
You need to pursue a petition to determine homestead status of real property (if the property was your parents' homestead). The Order determining homestead status would then transfer title to the house to you. It would serve your interests to consult with a probate attorney in your area to ensure that the conveyance is done right.

Can I represent my deceased mother? How?

The language used in the will determines whether you and your siblings can inherit your mother's share of the estate. Once the will is filed with the probate court, you can ask to see it at the clerk's office.
