I have joint tenancy with rights of survivorship with my mother. Can she quit claim her interest to someone else before she dies?

Either joint tenant may convey their interest and sever the joint tenancy. It will then be held as tenants in common.

Is it legal to leave one of your children out of your will?

Answered by attorney Kenneth A Prigmore (Unclaimed Profile)
Estate Planning lawyer at Prigmore Law
You are free to put whatever you like in your will. If you name one child, and leave the other out, your will is still valid. Make sure that you are following the requirements for wills in your state. Your state bar office will usually have some information to give you regarding how to prepare a legal will.

How do I know what type of trust that I need?

Answered by attorney Mark L. Dodds
Estate Planning lawyer at Grant Morris Dodds
There are so many things a trust can do, and so many different ways these things can be accomplished, the only way to know what kind of trust you need and what the trust must say is to engage the services of a competent, experienced attorney who is well-versed in trust law. In addition, the tax implications of a trust are usually highly significant as well; therefore, the attorney should understand tax law and how to achieve the tax results you are looking for.
