Probably not, but why did he build it and has he been using it? If it is an improvement to the land, you may have to pay him the value of the shed.

Asking permission is the best way. Since this is an estate planning Q, I assume it involves an estate. There is a judge assigned to every estate. You can schedule a hearing before the judge and ask him to compel the family to release your items to you. Probably should go thru a lawyer but not required.

Contact an attorney and discuss the size of your father's estate etc. The attorney will be able to tell you whether probate is required and how/if you will be able to get the money back from your mother.
