What's the cost to have a estate document done?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
Whether you can open an estate using a small estate affidavit or must file an application with the local probate court turns on state law and the size and nature of your father's estate.  Either is likely to cost more than $600.  If that is all he left (besides some old clothes and shoes), you may prefer to let the check go to unclaimed property with the state comptroller's office and, years from now, try to prove to that office who your father's heirs are.

What is the legal way going about getting items that belong to you but are not at your residence?

Answered by attorney Robert James Slotkin (Unclaimed Profile)
Estate Planning lawyer at Robert J. Slotkin
Asking permission is the best way. Since this is an estate planning Q, I assume it involves an estate. There is a judge assigned to every estate. You can schedule a hearing before the judge and ask him to compel the family to release your items to you. Probably should go thru a lawyer but not required.

Will I be responsible for his debts when he passes away?

Answered by attorney Larry Dale Webb (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Larry Webb
Generally the debts of the decedent are charged against his estate. If you inherited the house, the mortgage liens remain and you must pay the mortgage or refinance in your name. Is your mother's estate still open, if so why?
