No, you should never cross out provisions in your documents, because this could inadvertently be considered a revocation of the documents. It is possible, if the documents are properly worded, that nothing needs to be done, at this time. The documents should clearly state what happens if the named beneficiary is predeceased. If it is not clear what happens, you should contact your attorney and clarify this issue. It is relatively rare that this would require amended or new documents.

Ask an attorney to help you you communicate with the estate lawyer so that you can turn over what you have and be done with it. It is really his child and the child's mother who have the standing to complain, but if you are paying for the storage, you are at least able to find out when they are going to get your brother's things.

A reasonable time.. Ask the trustee for the distribution in writing.. If the trustee does NOT give it to you contact an attorney You might have to file an action against the trustee for a full accounting of the trust.
