This is a very complex problem. If father left no will, 13-year-old is entitled to a part of his estate. Also, 13-year-old should not be made homeless. If the other three kids won't discuss settling the estate, then I'd start by talking to the county sheriff about 13-year-old being locked out of his or her house; that sounds like child abuse to me. That's kinda the nuclear option; the young child really needs a lawyer to help sort this out.

You need to contact an attorney at once. If there was a will, one result may be that you get nothing from the estate. If there is no will, your stepfather would inherit with the children of your mother which include you. Only contacting an attorney will give you the information that you need. If there is no will, who will be the Personal Representative is also an issue that you need to discuss with an attorney.

You would want to consult a probate attorney who has experience in asset recovery actions. As far as criminal charges go, you may file police report, but in many jurisdictions there is simply not enough manpower in the DA's office to prosecute these types of cases. Again you may pursue a civil remedy regardless of whether the matter is prosecuted by the DA. Good luck to you.
