Is it legal for my brother to make a document that gives him certain rights to the property?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Estate Planning lawyer at Hernandez & Suarez, PL
If the document your brother has was executed as a last will and testament with all the requirements and formalities of a last will and testament and was executed last, that's the document that will prevail. However, just a simple document, although notarized but without the formalities of a will, will not supersede an existing Will.

What do I do if I was removed as a beneficiary but was still asked to pay for the mortgage and bills?

Answered by attorney James Bloomfield Oberholtzer
Estate Planning lawyer at James Oberholtzer, Chartered
This is a strange story. I would need to know a lot more about it to have any opinion. I would guess it involves a trust and possible a tenancy in common.
