You need to speak with an experienced estate attorney to go over homestead exemptions, policy ownership, policy amount, and available allowances as a surviving spouse under state law. There is not easy answer to your question, aside from you need to speak with an attorney to address options, which may include bankruptcy. Seek out legal assistance sooner rather than later.

If your parents are deceased, and the sister has the original will AND she's refusing to probate it, you can file an action in probate court forcing them to deliver the original wills to the court clerk. If you can't afford to pay a lawyer to do it, you might check with a local law school and see if a legal clinic or law professor can assign a student attorney to do it for you.

It is a crime to fail to file a will for probate. I couldn't guess what any particular attorney would charge. You should hire an attorney in the county where the mother resided at the time of her death.
