My sisters refuse to give me a copy of my parents' will for 2 years already, what can I do?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
If your parents are deceased, and the sister has the original will AND she's refusing to probate it, you can file an action in probate court forcing them to deliver the original wills to the court clerk. If you can't afford to pay a lawyer to do it, you might check with a local law school and see if a legal clinic or law professor can assign a student attorney to do it for you.

Does a quticlaim deed to one child remove other heirs from any consideration

Arthur Harold Geffen
Answered by attorney Arthur Harold Geffen (Unclaimed Profile)
Estate Planning lawyer at Dallas Estate Attorney
A quit claim deed is a deed without warranties of title from the owner of the property to one or more individuals or entities.  It effectively (even though it is not a great way to transfer title) removes the title from the owner's estate.  When the owner who deeded the interest away dies, the property is not part of his estate and thus not subject to his will or intestacy laws.

Can my husband put his name on the deed of his brother's condo if he has a POA over his assets?

Answered by attorney James P. Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
This is probably not something he should do, unless there are lots of other facts. If your husband was the only heir of his brother, it would make it a little easier to say yes. Same thing if the brother's Will says everything goes to your husband. If a court approved it. More information is needed.
