If the debt was in his name alone and was not secured by collateral, the debt becomes a debt of his estate, and not of his heirs. Any property owned by his estate would be potentially subject to satisfying the debt.

You probably need to file a small estate affidavit for both of your parents in the counties where they died. If your mother and father died with less than $50,000.00 in assets (not including their homestead real estate), you may file a small estate affidavit to transfer their assets to your name. It's unclear if you have siblings, but if you do, each of you will own equal shares of the property left behind. I recommend you contact an estate planning attorney to advise you on the specifics of your case. Good luck.

A power of attorney is a delegation or sharing of rights by a living person and is invalid after the death of the principle. An agent acting under power of attorney should have the document, though in Texas a copy of the document has the same force and effect as the original. Also in Texas, a medical power of attorney and a statutory durable power of attorney are generally 2 separate documents governing medical and financial matters, respectively. The statutory form for power of attorney in Texas requires the principle sign before a notary.
