If the power of attorney expires when my father passed away, who is to sign the quick claim deed to transfer my father’s home ownership and title?

Answered by attorney Charles Richard Perry (Unclaimed Profile)
Estate Planning lawyer at Charles R. Perry
If the home was in a living trust, then the trustee can sign the deed. If there was no living trust, then your father's estate must pass through probate. The court-appointed administrator of the estate (which could be you, if you ask for the appointment) will have the power to sign a deed in favor of whoever is to receive the property in question. I suggest you contact a probate attorney for assistance in this matter.

I have a trust but would like to make some changes, can this be done?

Estate Planning lawyer at Probate Law Center Richard J. Keyes, PC
You need to read through the trust to determine whether it is revocable or irrevocable. The vast majority of trusts are revocable. If you are still unsure, please see an attorney. If you want to make a change to your revocable trust, this is a trust amendment. You can go to a different attorney for the amendment or to find out if the trust is revocable so an amendment can be made.

What do I do if I was removed as a beneficiary but was still asked to pay for the mortgage and bills?

Answered by attorney Jessica Robin Barsotti (Unclaimed Profile)
Estate Planning lawyer at Law Office of Barbara A. Goode
I am sorry to hear of your loss. This must be very difficult for you. The lawyer cannot change the beneficiary designation. Did your son have a will or any children? If he had neither, then you may be the beneficiary of the house. If you have paid all the expenses for the last two years you are at least entitled to get that back. It seems that the lawyer is playing games here.
