You need to meet with an attorney to discuss what you are trying to accomplish. Generally irrevocable trusts are not the best way to go, especially with a minor child, because things change over time. If you are simply trying to provide for your child in the event something happens to you, you will have much more control and flexibility with a revocable instrument that can do the same thing. If you are appointed in Missouri as personal representative of your mother's estate, the actions you take as personal representative do not go on your credit report. You should see an attorney about opening up a probate estate. You may not need to open up a full probate estate. If you paid the funeral bill and it is more than the value of the car and the bank account, you may be able to do a creditor's refusal.

You do not have any grounds under which you can take possession of the vehicle, drive it, transfer title to your name, or sell the vehicle. Only your mother can give you permission to do those things. If she is permanently disabled and unable to take care of her affairs, you can petition a court to name a guardian and/or conservator for her and that person can decide what to do with the truck.
