What is about the unfair housing practices?

If you pay in cash and get a receipt, then that puts you in a difficult position. You always want to have a paper trail to back you up. Always. That prevents situations like this from happening. You can get the former owners to intervene on your behalf, perhaps, but otherwise, I think you are in a tough spot. If I am a judge looking at your case, it would be a toss up.

Do I need to open up an estate?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Have an attorney review title. If your mother's estate is entitled to $50,000 from the sale proceeds a review of the title will make that clear. If so, it is small enough that a probate should not be required but a summary probate proceeding will be required distributing that $50,000 to your mother's heirs. It will be unavoidable and you will need help so call an attorney.

Will the deceased children (her step-children) become the new beneficiaries?

Unless the Will specifies that the stepkids will inherit, then the answer would be NO. Stepchildren have no inherent rights under Michigan law and are not considered to be heirs. If the Will does not say otherwise, your cousins "next of kin" would inherit.
