If a will was left to 3 brothers to equally share property and a home and 2 have deceased, does the remaining brother get all shares?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
Not necessarily, it depends upon how title is held and what the Will states. Has it already gone through probate? I urge you to speak with an attorney who can review the paperwork and title and advise you.

Is the HELOC a community debt that can be allocated in probate court so that I am only responsible for half of it?

Boy, did you get tattooed here. Obtain the services of a beneficiary litigation attorney who can bring a probate action against the executor/administrator of the estate to challenge the disposition of the property and the liability allocation for the loan. Unfortunately, your position is not good if you do nothing, and the bank can foreclose; if the property is not yours, you may want to let the bank foreclose.

Obtain the services of a estate planning lawyer to file a conservatorship of your grandmother ASAP, to protect her; at the very least contact Adult Protective Services for your county and report the problem, so APS can protect her.
