Unless it is clearly stated in the documents, the right to a property does not include the right to the contents. The wife would be entitled to any and all contents. She would not be entitled to fixtures. If you are concerned about this, then you need to meet with an attorney to determine how best to proceed.

From what you've written, I can't tell if $45K is reasonable. In all likelihood, you could get the compensation reduced or a surcharge levied (same effect). Whether it is economically or socially wise to pursue this is another matter. You might spend $10K in order to save $5K.

You didn't give me enough information to answer this properly. How did your brother take it away? If your mother left a probate estate but didn't provide that the property went to you and your brother was named administrator (personal representative/executor) he may have sold the property to generate cash.
