Who would be liable the attorney or the executor of the will if the attorney didn't draw up trust fund before handing out estate money?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
More information is needed. Have the will/trust reviewed by an attorney. It sounds like it might be worth it at this point as things appear to have done wrong, regardless of fault, and fixing it should be the priority.

Can this be contested, what type of attorney would I need and can I press criminal charges on the person who did it?

Answered by attorney Tres Andrew Porter (Unclaimed Profile)
Estate Planning lawyer at The Law Offices of Tres A. Porter
1. The only type of attorney who can file criminal complaints is the County D.A. office. 2. If you want to contest the transfer of the property in civil court and/or sue for damages, you need to find a probate attorney, a real property attorney, or preferably one who practices in both areas. Either way, you should definitely consult with an attorney as soon as possible.

Would my mother's debt and lawsuit be charged on me if I probate her assets?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
No, her debt does not become yours, but you need to properly notice the creditors before you receive the assets through a court order. This needs to be accomplished through a court proceeding called probate. The creditors are a higher priority that you as a beneficiary, so they get paid before you inherit. You should speak with an attorney who experienced in these affairs where you mother resided to address your next steps.
