Unless you have a very large estate that will subject you to inheritance tax (ie over $3 million) you may not need to set up a life insurance trust. Those are normally used to provide the proceeds of a large life insurance policy to a beneficiary and avoid estate taxes. If you do have this issue, I would consult an attorney, but in essence you should set up an irrevocable life insurance trust. A revocable trust will not provide you with the tax benefits. If you do not have this issue, you could probably just designate your child as the beneficiary of the proceeds and set up a regular revocable trust to manage the assets in the event that your child is still a minor when you pass.

Who would be liable the attorney or the executor of the will if the attorney didn't draw up trust fund before handing out estate money?

Sounds like it would be the executor by not requiring it to be done. Actually, if the trust is in the Will, then accounts need to be set up, etc. That is typically not the attorney's responsibility.

If person on mortgage passes away and I am on the deed, how can I keep the property?

It should not have been possible for you to be an owner without being a party to the mortgage. The question becomes one of priority did your roommate deed you your interest in the property after taking the mortgage? (Or did you deed all the property to Roommate, the mortgage got signed, and Roommate deeded half back?) In that case, you'd be subject to the mortgage and you'd have to pay it. There are a couple of important questions: is the deed a survivor-ship deed, so that you inherit all the property? Or are you now joint owners with whoever takes Roommates intestate estate? If the latter, are these people you can work with? I recommend that you have a lawyer review the specific details. A few hundred dollars of legal advice now may help you avoid a big mistake, or avoid a large loss.
