I would recommend a petition to the court to enforce a preliminary distribution with money to be withheld to help defend the NY action.

It depends upon the nature of the promises. Honestly it is difficult to do anything from a legal perspective unless you have a written contract or in some cases evidence of an oral contract.

"I have a trust that I can't touch." What does this mean? Every trust has three parties: Settlor (or Trustor) who forms the Trust and puts something into it. Trustee who manages the Trust Estate. Beneficiaries who get the economic benefit of the Trust. It is certainly possible for you to be trustee of a trust from which you are not authorized to take distributions for yourself. Guardians are for minors only.
