Answered by attorney Brian Haggerty (Unclaimed Profile)

If that's the right result (will that gives the house to spouse, or no will and no children) then you need to administer the estate.

Do I need a will if I only have non-probate property that will go to my son and only beneficiary? Wish to avoid probate. No real property involved.

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
If all you have is non-probate property, all you have is property which does not pass under a Will.  In that circumstance, you do not need a Will.

How do turn over our share of land to our brother?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Speak directly with an attorney. You will either have to go through probate or a summary probate to transfer the land and a probate attorney can help you do that.
