That is a complicated question. You should sit down with an attorney to address establishing an estate plan that may include a Trust. Some of the issues you will need to address if how has the home been paid for, monthly payments, etc. What is the total value of the probate estate? In Nevada if less than $100,000 then it all goes to the surviving spouse even if you leave a Will stating otherwise. Do you need a trust to protect yourself and your family. What interest do you want your husband to have? What is he entitled to? Better to sort this out before something happens and the two sides of the family end up in court. You need to request a duplicate title from the Missouri Department of Revenue. In order to transfer the title after you get it you must open an estate in the probate Division of the circuit court in the county where your mother was living when she died. You will either have to have a full administration or some form of abbreviated procedure. You need to retain a Missouri attorney to help you with this.

At 18 you are a legal adult and can have power of attorney over someone else. This assumes that your mother is mentally competent to grant the POA, and is willing to revoke the POA granted to your step-father and give it to you instead.
