How do turn over our share of land to our brother?

default-avatar
Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
It is difficult to answer a question like this without more complete information about the estate, and how the land will transfer in the first place. If your mother passed in July of 2013, you should still have time to "disclaim" your share of the land that might do what you want, but more information about the family is needed. You could simply deed your portion to your brother, but first you need to make sure that you are properly in title to the land, and this approach might involve a need at least to file a gift tax return. Honestly, it's land it must have enough value that it's worth hiring a lawyer to make sure things are done correctly.

Will a prenup help me to kick out future step parent from my parents house? We have a Will that leaves all to me and my brother.

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
In Texas a surviving spouse has a lifetime right of occupancy in the home.   Your father's Will may or may not say that he contracted with your mother not to revoke the Will in order to provide for her and for children of their marriage.  If it does not, he could Will the home to his new spouse.  You are correct that she could give up her right to a community property interest in the home in a valid prenup (or a valid Marital Property Agreement).  She would still have a lifetime right of occupancy and, if she paid on the mortgage or made other financial contributions, a right to be reimbursed for them.

Would having a possible credit card judgment pending affect her chances of getting the reverse mortgage?

Answered by attorney John F Brennan (Unclaimed Profile)
Estate Planning lawyer at Musilli Brennan Associates, PLLC
I would suspect that your mother will be asked to pay off the credit card judgment as part of the conditions for the reverse mortgage. She should speak with an attorney.
