This is not my area of expertise, but if the fence is on their property, they do not need your permission. Unless you have an agreement with them, your Grant Deed gives you some type of easement to their property or they are in violation of the Homeowners Rule and Regulations, I don't see why they would not be able to put a fence on their own property.

The rights of all of your mother's living siblings and the heirs of the deceased sibling will depend upon who has legal title to the property. Although you don't say, I'm assuming that the property is held either jointly or as tenants in common by the surviving siblings and possibly by the heirs of the deceased siblings. If that is the case, then all would have a right to determine the use of the property.

Answer to Question #1: The estate comes into play when someone dies with an estate. The deceased person will either have a Will with instructions to how the estate is to be divided, or does not have a Will, in which event, the state statute will determine the distribution. In either event, there will be a probate of the estate in the court of the residence of the deceased, unless the deceased created a Trust, in which case, the trust provisions will be instructive as to how and when the distribution to your self should occur, and there would not be a probate proceeding. Answer to Question #2: It appears to me, if your father is deceased before your grandparents, then anything your grandparents would leave to any remaining siblings, I e , your aunt and uncle, is their decision alone, as they do not have to leave any estate to anyone else by Will or Trust; however, if they die without a Will or Trust, then their property, if any, would devolve down two levels here in California, which means the property would be divided between any remaining siblings and any remaining children of deceased siblings, via a petition to administer the estate in probate.
