Go in there and take pictures. When the estate is opened, have the judge sign an order compelling your uncle to account for what he took. Meanwhile, go in there and secure any remaining items of value and get the lock changed on the house. You will have to open a probate estate to deal with the house and its contents and any accounts that were titled in your father's name. You should contact a lawyer for that.

If within the documents of the Association (much like a Condominium Association) it requires such approval, then yes they can have the right to prevent a new owner. It is not as common with HOA's, but it does happen.

This is a fairly common problem. Either way, you are potentially setting yourself up for litigation, if there is a problem. Even if she is not on the title, if she is contributing money to the house, then she arguably has an equitable interest. I guess the answer depends in part on your future plans.
