Do a living trust. If you add him while you are alive, that is when you are creating a tax issue. If you leave it to him on your death he gets what is called a "step up in basis" and it will be a non-tax event.

Unfortunately you have no legal right to stay. You could make him evict you however which will buy you more time. It would be a shame if it came to that and would be ideal if he would advance you money from the probate. My recommendation would be you find a permanent place to live - a motel is expensive and only temporary which is usually not the best choice.

The state will not get involved as long as you and/or your brother file a Petition for Probate and administer his estate. If you do that, the assets will go to you and your brother. Speak with an attorney ASAP.
