In order to settle an estate valued under 150,000 without probate does the real property have to be less than 50,000?

Answered by attorney Richard Joseph Keyes (Unclaimed Profile)
Estate Planning lawyer at Probate Law Center Richard J. Keyes, PC
In Missouri, no matter the value of the assets, you need to open up a probate estate if the decedent died with assets in her or his name only with no beneficiary designation on the assets. In Missouri, the small estate affidavit is for estates with net assets less than $40,000. You would subtract the deed of trust value from the market value, leaving you with approximately $30,000, but then you need to add in the value of the personal property which would take it over $40,000. See an attorney for more details.

What do I file after the death of my mom?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
Based on your post, it appears that probate may not be necessary but, if there was a will, that will should still be placed on deposit with the clerk and the death certificate (without cause of death) should still be recorded in the public records of the county where decedent passed away. Also, it would still be prudent to consult with an attorney to ensure that indeed no court action must be taken. All the best.

Can my father's wife get all his belongings even if she was left one dollar in his will?

Estate Planning lawyer at Richard J. Kaplan, P.A.
Unless there is a anti-nuptial agreement in place, a deceased spouse can no longer disinherit a surviving spouse in Florida anymore. So the $1 possibly won't work. She would be entitled to at least 30% of his worldwide assets, with set offs of assets that may have been jointly owned between them or she received as a distribution from him. This includes assets that were jointly owned with someone else or payable to someone else (like in life insurance).
