What do I do if my ex husband died suddenly without a will?

Answered by attorney Robert James Slotkin (Unclaimed Profile)
Estate Planning lawyer at Robert J. Slotkin
Automobiles may be handled outside of probate and you do not need a lawyer. The car belongs to the estate but his heirs can obtain the legal title by taking a death certificate and the title to any auto tag agency. You are not an heir so get the heirs to assign their right to you - that is all you need. The tag agency can help you with this. You will still have to deal with the loan.

If the house is listed as homestead, does the house get put in probate?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
Homestead is not a probate asset but a petition to determine homestead status of real property will likely have to be filed if the deed was in your mother's name alone or she was the last to die. It would be prudent to consult with a probate attorney in your area for specific advice.

Can I represent my deceased mother? How?

The Will doesn't do anything until it is presented to the court for probate. At that point, everybody can read it; the petition for probate will contain specific allegations concerning who the heirs and devises are.
