How do I get half of whatever money my family member left?

Answered by attorney Christopher Emmanuel Benjamin (Unclaimed Profile)
Estate Planning lawyer at The Barrister Firm, P.A.
There should have been a final accounting and distribution filed with the Court; you may take a look at the Court file to see what she has filed with the Court and if there is any that is untrue you should bring it to the attention of the Court or retain counsel for assistance.

What are the sons right on father's property if will states only one son will inherit?

Answered by attorney James Bloomfield Oberholtzer
Estate Planning lawyer at James Oberholtzer, Chartered
In Oregon, a parent may disinherit his children entirely if he wishes. He cannot entirely disinherit his spouse. It may not have been done effectively, so it may be a good idea to have an attorney review the entire situation.

If we refinance only in my husband's name will that take my name off the deed?

Answered by attorney Michael Shane-Morrissey Koch (Unclaimed Profile)
Estate Planning lawyer at The Law Office of Michael Koch, P.A.
In order to remove your name from the deed, a new deed would need to be prepared (or upon your death your interest will pass to your spouse automatically should he outlive you.) However, the company who refinances the property will never, never, never lend money to your husband without you and anyone else owning an interest in the property (names on deed) signing the mortgage.
