Can I set up multiple living trusts and put different properties in each?

Michael N. Stafford

Although it is more economical feasible to put all your properties in one trust you can set up two trust and put separate properties in each trust.

If my father planned for separation, does this factor into her claim?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
No. Texas law does not recognize a separation. The spouse would be entitled to 50% of the community estate. There may be an issue as to what is considered community property, and what is separate property, however.

How do I get the home in my name if my mom moved out of her home before she died and I took over the home and the payments?

Answered by attorney David L. Leon

You will need to use the probate process. The correct process depends on whether or not your mom had a will and/or debts.
