Not sure why you are asking this question in CA. Honestly you need to hire an attorney in Illinois to force the will out and into probate. Don't wait as your sister will clearly not do you any favors.

He can't. That would be stealing. If your mother gave you a gift (she intended for you to have the property, and she actually delivered the property to you) then it is yours.

It will depend upon the terms of the mortgage. Usually the property reverts to the mortgage holder upon the death of the owner. They may be willing to rent the property but it's more likely they will choose to sell it.
