It sounds like the case was filed, if this is the case, the statute of limitations is not applicable. If you are unhappy with your court provided representation, you should consider seeking alternative counsel (read: private counsel) but that will cost you more that you are paying for representation. Many attorneys in your local area handle DUI cases, some of them may even do so exclusively, I encourage you to contact a private attorney to discuss your facts and what your goals are with the representation, it may not cost as much as you think to hire an attorney to help defend you.

If I was charged with a DUI and I asked for a test and the officers would not give me one, what can I do?

To be clear, you were arrested for a DUI, but the officers never gave you the option of doing a blood test (assuming they were arresting you for a drug dui), or a blood or breath test if cop suspected alcohol? Are they charging you with a refusal? If so, did they offer the test(s), but you initially refused? Whatever the case is, what you can do is contact a DUI attorney or two in your area to discuss your situation and what happened leading up to the arrest in more detail. If they are not charging you with a refusal, and they don't have any test evidence, you are in a good situation to defend this DUI.

You don't have to tell the officer anything. You can refuse the portable breath test (the small hand held device used in the field). You can also refuse the breath test at the station, HOWEVER, if you do refuse that breath test, the Department of Licensing WILL revoke your license for a minimum of one year, even if you were ultimately found "not guilty" of the DUI. Also, your refusal of that test can be used as evidence against you in a trial. If you have a DUI, you should have an attorney. These are complex cases and the sakes are high.
