Are DUI field sobriety tests pass or fail?

Answered by attorney Patrick Owen Earl
DUI/DWI lawyer at Patrick O. Earl
These tests are just balancing test that law enforcement and the law use to determine if the officer thinks the person has had too much to drink. The Pass/Fail idea is probably correct but it is more than that. The count up clues that the person does or doesn't do and then with the observations and smell and attitude of the person determine if they believe he/she has had to much to drink.

Misdemeanor DUI convictions cannot be expunged from a criminal record for 7 years and then only if the sentence has been completed satisfactorily.

I was given a refusal to breathelyze, reckless driving and a dui how long am I likely to loose my license

'refusal' and 'dui' are two separate charges with the possibility of two separate sentences. the key is to have one conviction and one sentence.  is this your first 'dui' conviction ? if so, the loss of license is at least seven months. please let us know if we can help. ed dimon, esq. 732-797-1600
