Would I get jail time for a second DUI offense?

You could potentially be sentenced to 10 days to 1 year in the county jail. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

What will happen if I missed a hearing for a show cause over a DUI and how can I fix this without going to jail?

Richard B. Jacobson

If you have a lawyer, speak with him or her about arranging a time for a new appearance at a rescheduled hearing. If you do not have a lawyer, it would be good to retain one. If you cannot at all obtain legal counsel, you could telephone the prosecutor and tell him or her that you forgot to appear, and would like to reschedule. They may agree, and may impose the condition that you come to the courthouse to receive a "notice in hand,' telling you of the time and place of the hearing.

What can I do if I was falsely accused of tampering with ignition interlock?

This is a horrible problem that many have with interlocks. You have to request a hearing with the DAAD and prove to them that you did not tamper, by your testimony, car repair receipts, etc. You will probably get reinstated if it shows that you blew immediately afterwards and had a .00 reading for your bac. I have done many of these and the biggest problem is waiting the 6 to 8 weeks to get a hearing, which nothing can be done to speed up the process. It is also wise to have an attorney familiar with the DAAD in which you have to report to.
