How does someone obtain a license in another state if they have a DUI felony in NY?

Another state will have its own regulations concerning becoming licensed if one is revoked in NY. Your fiance is the victim of the new changes made recently in the "look back" period which makes 3 drinking related offenses or more subject to lifetime refusal to re-license him in NYS. At present, there are numerous people similarly affected. Attorneys are presently wrestling with the problem and seeking ways to mitigate this damage, but there is no apparent solution at the moment.

Hi, It depends on what it is you were actually charged with and ultimately what you pleaded down to. If you were charged with a DWI, but took a violation and a 90 day license suspension, for instance, then it will not be on your record. New York state criminal record searches do not include violations, so if you received one, it won't show on your record. Misdemeanors will.  Unfortunately, NY State does not allow the expungment of a record, so if you have one, it will show when a search is conducted, despite the fact that it occurred so long ago.  I hope this helps (hard to answer in more detail without knowing complete specifics on your case). Ask for the information, if it exists, after you are charged. They should give it to you or at least allow you to view it. The cost of representation is cheap, compared to the cost which will be visited on you if somehow your defense is botched.
