Depends. They will definitely look for alcohol, and then maybe drugs if it is close or under. Yes, they can still come after you for being intoxicated due to drugs or any combination thereof.

There is nothing you can do at this point but wait to see what happens. However, if you do get a charge of DUI contact an attorney and explain what you have posted here online. The police must provide you with certain rights before giving you a breath test and it certainly doesn't sound like they were given. If you get the DUI charge call me or another attorney as soon as you receive it.

I had 3 DUI back when they had the 10 year rule and I was over that so I wasn’t charged for a felony back then is this correct?

So if it was not a felony at the time it was charged years ago, it does not become a felony now because the law has changed. However, be aware that if you get another one - ever - you can be charged with a felony.
