What can I do if I missed a court date but I was only the passenger not the driver?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
It depends on why you were summons to court, if you were a witness, contact the DA and see if there was a subsequent court date set. If you received a citation of some sort, you will need to add your case back on the court's calendar. You may be taken in to custody or bail set. If this second scenario is your situation, contact a criminal defense attorney in your area to assist you in this process.

I had 2 dui 25 years ago can I get a Nebraska cdl

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
DUI/DWI lawyer at Miller & Harrison, LLC
If you just had ONE DUI, and it was 25 years ago it likely will not impact your ability to get a CDL (per the Federal regulations) in Nebraska - BUT you may have to do soemthing in the state you got the DUI in order to have Nebraka be okay with you getting a CDL.  As for Nebraska law, you will have to check with a Nebraska lawyer.

Can my son get his DUI dismissed since he didn't take the breath test?

Answered by attorney Steven Fairlie
DUI/DWI lawyer at Fairlie & Lippy, P.C.
They don't have to charge the headlight violation to be able to justify the stop based on it. Not the answer you wanted, but that is the law in Pennsylvania. They can also charge him with DUI based on observations even without a breathalyzer, but, depending on the observations, I agree that the fact that another officer let him go gives you a great defense. You only need to establish a reasonable doubt. Call a good Pennsylvania DUI lawyer.
