It depends on the policies regarding this program, these are set by the county department of corrections. I have never had a client arrested on the spot for failing to enroll in the community service in a timely fashion. You should consult your lawyer regarding the policies in your county.

The test at the scene is different than any taken later. It is possible that the second test could be higher than the first. This, however, is probably better news because it shows that you may not have been intoxicated at the time you were driving. Find an attorney as soon as possible.

If you were driving, and the blood labs come back with a controlled substance in your system, you could be charged with DWI. If that happens, feel free to contact me directly to discuss representation. I only do criminal defense. If you want to sue the police officer for assault, you would need to contact a civil attorney.
