I was charged with DUI and open container what will happen to me?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Its impossible to say what will happen to you. That depends entirely on the facts of your case. In Utah, though an officer cannot stop you for not having a seatbelt on. They have to stop you for another reason and then they can add that charge. (The Utah legislature is currently considering changing that.) You may be able to contest the legality of the stop entirely.

How can the court be waiting for my toxicology report if they never took my blood?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
The prosecutor or judge could have made a mistake and misspoke. However, in flipping your vehicle you may have left blood behind. Or when blowing you left the tissue you used to stop the blood behind.
