You should check all of your paperwork very carefully. If the officer provided you a citation when you were released from jail -it more than likely include a date to appear and the address of the courthouse. You must appear at that hearing, do not be late. If there was no date, then you should periodically check the local county court (most have websites) for a potential warrant or contact the county court clerk directly to see if a case has been filed. A breathalyzer evaluation and the results from it are a piece of evidence used to support the charge of DUI. Refusing to submit to the breathalyzer in NJ is a separate offense (you cannot refuse in NJ). Your son can still be convicted of DUI merely based upon the officer's observations.

It is entirely up to the judge; however, the longer you take to get the issue resolved, the more likely the judge will be to set a high bail, which you will have to post in order to get out of jail before your trial. The case is pending. It won't go away. Take care of it.
