With a lawyer you may avoid these consequences, DUI defense attorney's throughout California are litigating refusal cases, results are different based on jurisdiction and lawyer, these new challenges are based on a United States Supreme Court case that was decided in April. You should contact a DUI defense lawyer and see what they can do for you.

You will be going to jail on the bench warrant for failing to appear in court years ago. Then when you finally go to court, you will have to deal with the DUI charge. You do not need drivers license to shop for an attorney.

It sounds like you are doing everything right. An attorney could help because the SOS will compare what you submitted last time with the documents you submit next time, and if there are any inconsistencies, you could be denied. There is also an additional form that needs to be done, a newly revised petitioner's affidavit, which can be found online or you can request a packet with the MI Secretary of State. Being in AA for as many years as you have, not drinking since you stated you drank last time, getting good letters with everyone stating when your last drink was, that you do not associate with drinkers, do not keep any alcohol in your home and what you do for stress relief/recreation (nothing that has alcohol anywhere) also helps. Make certain you do not tell them anything that is different than last time. If you do not have your old documents, you can buy them for $7.00 from MI SOS. I will never represent someone unless I buy the old records. Since you submitted them in 2006, your memory may not be the same and if you tell them something different than you did last time, you will probably not win. Consistency and not drinking/drugging and going to AA is the answer. If you admit to even one New Year's Toast cocktail, you will be denied.
