Who is this mysterious "they" to whom you are referring? You have a DUI, the details of the status of your driver's license is not crucial to your prosecution for a DUI.

I got a DUI in a passenger seat and it was dismissed in court. How do I get DMV to give me my license back?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
Doubtful you can change the DMV ruling or appeal at this point. So you need to follow the rules to reinstate you license after a year. DMV is an awful place that loves to take licenses without good reason.
