You have to convince the DMV to give you your license. To do so the program you attended must meet the requirements of a 1st time dui program. Talk to the program and see if they can help you out. Your other option is to attend and complete the dui program. This is probably an easier and faster way to get your license.

Police often hide by the side of the freeway to trap speeders. I don't know of any judge who would dismiss the charges for this but yo can always try.

If the matter goes to trial, the prosecution must prove that your driving was impaired, and that your consumption of alcohol was the cause of the impaired driving. They are permitted to use the .07 BAC as evidence pointing to the likelihood that alcohol was the cause. Discuss your case with a skilled OWI (=DUI) lawyer, who can review all the facts in detail and give you more specific and helpful advice. Good Luck.
