You are looking at a possible felony DUI charge with a possible jail sentence of up to 3 years, 4 year license suspension, 90 day car impound, plus habitual offender status. If you have not done so already, I suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.

How do I go about getting my drivers license back?

It is doubtful that your restricted license is valid in Indiana. Someone else can drive your car; however, restricted licenses are usually only valid in Michigan. And again, if someone drives your car, they are going to have to blow into the interlock when asked to, when driving, before you start your car, just like you would have to do. You'd have to check with Indiana DMV to see if your license is valid. I've had many clients who have an interlock on and then have moved. It is a nightmare because you still have to have interlock calibrated in Michigan. This can be done by Fedex; however, it is expensive, with you paying shipment both ways. You should apply for another hearing 30 days before your interlock is on for a year, as it has to be on for one year minimum. You have to do everything you did before, final report from interlock company, drug test, substance abuse/alcohol assessment, petitioner's affidavit, letters in support of sobriety. You can do it without a hearing; however, I have heard that it is best to do it with a hearing officer and Lansing and Livonia are the more lenient. I would not go to Grand Rapids.
