Can I get a new driver’s license without doing classes?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
If you live out of state you can get a waiver for the DUI program from the Mandatory Actions Unit of the CA DMV. The only hitch is that you can't re-license in CA for 5 years, otherwise, if you were convicted of VC 23152 you must complete a CA DUI program crazy since alcohol was not an issue but, it's the law. A DUI lawyer may have been able to get a lesser conviction that would have saved your driver's license and prevented this problem.

Can DMV require SR 22 if DUI case was dismissed?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
Yes. DUI cases have two fronts to fight: the DMV and the Court. If you lose the DMV hearing, you will need an SR-22 for 3 years even if your case gets dismissed in Court. If you lose DMV, the only ways to unwind are to win on appeal or be found Not Guilty at trial. In order to keep you license and not need an SR-22 you must win your DMV hearing and not be convicted in court of a DUI, or be found Not Guilty at trial. If you hired an attorney and paid money for them, why aren't they answering these questions?!

How can they permanently take my commercial driving away from me if I haven’t been driving commercially for more than 10 years?

The DUI's are the reason your license is being suspended/ revoked for the DUIs . You don't get special treatment because you are a commercial driver.
