Can a police officer sue me for saying yes when he asked me if I had been drinking?

DUI/DWI lawyer at Musilli Brennan Associates, PLLC
Yes, your admission can be used in court against you. The correct answer to a question from the police is either silence or a statement that you intend to remain silent exercising your constitutional rights. Once you speak you are going to be held accountable for what you said.

Is it possible to get a reduced charge for a DWI if I was not caught driving?

Answered by attorney Mark R. Thiessen
DUI/DWI lawyer at Thiessen Law Firm
Sounds like a wheel witness issue. And if you have a big enough issue, the DA may reduce or even dismiss.

Am I responsible for the cost of the expert witness?

If you authorized your lawyer to hire the expert you presumably agreed at the time to be responsible for the expert's fees. So you're responsible for his fees. Expert witnesses don't agree to testify on the condition that they'll be paid only if the party who hires them is completely successful. Even so, this one's testimony seems to have been fully successful. How could an alcohol consumption/testing expert ever be expected to testify that you didn't leave the scene of an accident anyway? Pay the man, and recognize how fortunate you are to have beaten a DWI.
