Can or will state still prosecute me on DUI if I failed field sobriety test but passed breath and urine test?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
The state will prosecute you, because you cannot pass breath test. Being below .08 and .07 does not mean that you passed, it just means that you are not presumptively impaired. See website for info on retaining the right attorney.

How do I qualify for expungement or pardon when it comes to DUI and possession of marijuana?

Answered by attorney Larry K. Dunn (Unclaimed Profile)
DUI/DWI lawyer at Weo Office Suites, LLC
A misdemeanor dui conviction cannot be expunged from a criminal record for seven years. You should consult with an attorney who practices in the area of sealing records to ensure all criminal records reporting agencies remove the record from reporting systems.

I was charged with a DUI on a military base and I am a convicted felon what is going to happen to me?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The fact that you blew a .10 after drinking the night before is troublesome. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.
