You will be charged with Criminal Possession of a Controlled Substance in the 7th Degree for the Molly. Did you do a blood or urine test? If yes and it shows drugs you can be charged with DUI under VTL 1192.4. Even if you didn't take a test you can still be charged for DUI depending on the Police Officer's observations of you. I suggest you hire a good criminal defense lawyer.

An accused person has a statutory and constitutional right to disclosure of the evidence which is in the possession of the State and intended to be used against a person. The right to discovery can be asserted by a person who is representing them self (in proper person).

If the blood test from the hospital shows a blood alcohol level over .08% you will be charged with OUI. I am assuming that you are 21 or older. If you are under 21, then anything over .02% blood in your system will be grounds for the OUI.
