Can you be convicted of DUI if you were not driving?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Yes, Utah law requires a person to be in "actual, physical control" of the car and not necessarily driving. However, a jury might be less likely to convict if you were never driving. Hire a talented lawyer and you improve your chances of avoiding a conviction.

I received a warrant of arrest letter for an unpaid citation for speed exhibition, what are my options?

You can no longer simply pay the fine. To handle a warrant, you must turn yourself in to the issuing court, with or without an attorney. You'll try to negotiate a recall of the warrant[s] and negotiate a plea bargain on any Failure to Appear charge. You'll try to negotiate bail reduction or OR release. You'll try to negotiate a plea bargain or take to trial the outstanding charge that caused the warrant. On misdemeanors and infractions, your attorney can appear in court without the defendant being present. Effective plea-bargaining, using whatever legal defenses, facts and sympathies there may be, could possibly keep you out of jail, or at least dramatically reduce it. Unless you're competent to effectively represent yourself in court against a professional prosecutor trying to put you in jail, most people hire an attorney who can.

If I missed my DMV hearing is it possible to get it rescheduled or do I have to deal with not having a license for a whole year?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Joe Dane
The DMV hearing is only for alcohol related offenses. The hearing you must schedule deals with 3 issues: were you driving? were you lawfully arrested? Was there a chemical test within 3 hours that showed a blood alcohol level of 0.08% or more in your system? If this DUI is NOT alcohol related, there shouldn't have been any suspension of your license unless you're convicted of DUI in court. Something's not adding up here. You probably should sit down face to face with a defense attorney and discuss this further.
