It never gets removed. You can have a misdemeanor sealed after 5 years if found guilty, but drunk driving charges may be handled differently than other misdemeanors. It will also depend on the outcome of the OUI and the job you apply for. This year the time frames to seal criminal records was shorted from 10 to 5 years for a misdemeanor and from 15 years to 10 years for a felony. However, the viewing statute also became more complicated and we are still trying to understand all of the variables. Now there are five (5) different levels of what an employer may view of a potential employee.

Not really enough information provided, you should call your lawyer, he/she can help you get reinstated. If your license was suspended by the DMV you will need to take affirmative steps to reinstate your license despite your case being dismissed. If your case was dismissed because your lawyer prevailed in a pre-trial motion, you may be entitled to a new hearing. If your lawyer was able to get you acquitted after a jury or bench trial the outcome will set-aside the suspension when you, or your lawyer sends a certified copy of the verdict. If your case was dismissed in another fashion you will likely have to do some "hard" suspension, a DUI school, file an SR-22 and pay a reinstatement fee all of which will be determined by whether this was a first or multiple DUI.

Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.
