The problem you have is your license remains suspended due to DUI until you do what you need to do to rectify it which usually it is to attend the program and complete it I suggest you contact DMV to find out what you need to do to clean this up.

Sounds like you are being charged wiyh a VC 14601.2. The penalty for that can be more severe than the penalty you received for the DUI conviction. Talk to an attorney in your area to discuss defending the new charge (as well as license issues). Generally the new charge on it's own should not bar getting a license, but there can be exceptions.
