Can someone travel out of the country after a DUI? How?

Answered by attorney John F Brennan (Unclaimed Profile)
DUI/DWI lawyer at Musilli Brennan Associates, PLLC
I would have to see the conditions of your bond, but generally you would not be allowed to travel outside of the state, or the country, without the permission of the court.

Is it legal for police to take my blood against my will?

default-avatar
Answered by attorney Cindy Mannon (Unclaimed Profile)
DUI/DWI lawyer at Cindy Mannon, Attorney at Law
They have to obtain a search warrant to take your blood, unless you consent, and only if you refuse to take the BAC at the station. You have the right to refuse the pbt. on the side of the road, but if you refuse to take the datamaster which registers your blood alcohol content, they get a search warrant (really easy to obtain) and they take you to the hospital. However, if they find out you are a diabetic, they can take you to the hospital for a blood test without a search warrant.

Can a cop force a breathalyzer on the passengers of a car, even if the driver blew a zero?

default-avatar
Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
The police can do it, because they all appear underage and under the influence. It does not matter they are not driving. They cannot consume alcohol at all. So, IF they appear under influence, they have committed a criminal offense. What is confusing about that?
